Nahaharap sa panibagong reklamo ang 3rd TelCo ng bansa na DITO Telecommunity Corp. kaugnay sa umano’y ilegal na pagtatayo nito ng cell towers.
Ito’y makaraang maglabas ng show cause order ang National Commission on Indigenous People – Cordillera Administrative Region (NCIP-CAR) laban sa DITO TelCo dahil sa umano’y paglabag sa mga karapatan ng mga katutubo para sa kanilang ancestral domains (ADs) ng Benguet province.
Nanindigan ang mga katutubo sa kanilang mga karapatan para sana free and prior informed consent (FPIC) na itinatakda sa ilalim ng Section 59 ng Republic Act 8371 o ang “Indigenous Peoples Rights Act (IPRA)”
Nakatakda na sana sa darating na Marso ang Commercial Rollout ng DITO kung saan nangako ito na seserbisyuhan ang nasa 37 porsiyento ng populasyon ng bansa na may 27 megabits per second (mbps).
It has come to our attention that your company has undertaken or is currently undertaking fiber-optics laying in the various ADs in Benguet province without securing the FPIC [from] concerned indigenous cultural communities/indigenous peoples (ICCs/IPs) and paying just and fair compensation for damages [that] they may sustain as consequence thereof,” nakasaad sa show-cause order ng NCIP-CAR sa Dito mula kay Regional Director Marlon Bosantog.
Section 7 (b) of the IPRA [also] recognizes, protects and promotes, among others, the rights of the ICCs/IPs to an informed and intelligent participation in the formulation and implementation of any project, government or private, that will affect or impact upon the ancestral domains and to receive just and fair compensation for any damages [that] they may sustain as a result of the project.” nakasaad pa sa itinatakda ng IPRA.
Binigyan ng 15 araw ang DITO para tumugon at ilatag ang mga kadahilanan kung bakit hindi sila dapat papanagutin sa paglabag sa IPRA.
Una rito, may nakabimbing aplikasyon sa NCIP-CAR ang naturang TelCo para sa pagtatayo ng telecommunication towers sa La Trinidad, Benguet at kasalukuyang nasa preliminary stages pa rin ng FPIC process.
Kamakailan, kinasuhan ng Pamahalaang Lokal ng Malabon ang DITO Telco dahil sa paglabag sa Section 301 ng Presidential Decree 1096 o ang National Building Code of the Philippines sa o ang iligal na pagtatayo ng cell site sa lungsod.
May isyu rin sa DITO ang LGU sa lalawigan ng Cebu laban sa road engineering works nito na isinasagawa sa main thoroughfares sa isang commercial district na nagdulot ng mabigat na daloy ng trapiko.
